SecondRing – Terms & Conditions
1. Introduction
1.1 These Terms & Conditions (“Terms”) form the agreement (“Agreement”) between SecondRing (“we”, “us”, “our”) and you, the customer (“you”, “your”), for the use of our VoIP and related telecom services (“Services”).
1.2 By creating an account, purchasing any plan or using our Services, you confirm that you have read, understood and agree to be bound by these Terms.
2. Important information about VoIP & emergency calls
2.1 SecondRing is a Voice over IP (VoIP) service. The Services depend on:
- Your internet/broadband connection,
- Your local network and equipment, and
- Power at your premises.
If your internet connection, local network or power supply fails, the Service may stop working.
2.2 Calls to emergency services (999 / 112) may be supported, but cannot be guaranteed in all circumstances. Calls to emergency services may fail if:
- There is a power cut,
- Your broadband or data connection is down, or
- Your equipment is not configured correctly.
2.3 You are responsible for ensuring that the address details you provide in your SecondRing account are accurate and kept up-to-date. Where supported, this address may be passed to the emergency services for location purposes. If you move location or use the service elsewhere, you must update your details.
2.4 Legacy devices such as healthcare monitors, fall alarms, burglar alarms and other equipment designed for traditional PSTN lines may not work reliably over VoIP. You must check compatibility with the device manufacturer or alarm/care provider before using such devices over SecondRing. We accept no liability for loss, injury or damage arising from the failure or malfunction of such devices when used with our Services.
3. Services we provide
3.1 Subject to these Terms, SecondRing will provide the telecom and related Services you have ordered as described on our website or in your order confirmation.
3.2 We will use reasonable skill and care to maintain a reliable Service, but no Service Level Agreement (SLA) or uptime guarantee is given unless explicitly stated in a separate written contract.
3.3 In the event of a fault or outage, we will use reasonable efforts to restore the Service as soon as reasonably practical.
4. Term, renewals & contract length
4.1 Unless otherwise stated, SecondRing Services are provided on a 30-day rolling basis from the date your Service is activated and payment is received.
4.2 At the end of each 30-day period, your Service will automatically renew for a further 30-day period unless you cancel in line with these Terms.
4.3 We reserve the right to refuse or cancel any order before activation if, at our sole discretion, we consider the order inappropriate, fraudulent, incomplete or otherwise unacceptable.
5. Fees, payment & calling charges
5.1 All prices for our Services are shown on our website or in your order journey and are subject to change. Any change to monthly/recurring fees will apply at the start of your next billing period.
5.2 You agree to pay all charges associated with your account, including:
- Monthly or recurring subscription fees,
- Call charges (including call forwarding/divert charges),
- Any setup, porting or admin fees shown in your order or on our website, and
- Any applicable taxes or government fees (except our own income tax).
5.3 Where you authorise payment by debit/credit card, you grant SecondRing the right to take recurring payments for your active Services and any auto top-up settings, until you cancel the Service and all amounts due have been paid.
5.4 If we cannot collect payment, we may:
- Mark Services as expired or suspended,
- Ask you to make payment via your online account, and
- Terminate the Agreement if amounts remain unpaid.
5.5 You are responsible for all calls made using your account, whether authorised by you or not, including any calls made as a result of hacking, compromised passwords or other unauthorised access.
6. “Unlimited” minutes – fair use & 1,000 minute cap
6.1 Where a plan is described as “Unlimited” for outbound calls, this means it is subject to fair usage and is capped at 1,000 outbound minutes per user, per 30-day billing period, unless we state a different limit in writing.
6.2 Once you reach the 1,000-minute allowance:
- We may charge additional calls at our standard per-minute rates, or
- We may restrict further outbound calls until the start of your next billing period.
6.3 Unlimited plans are intended for normal business or residential use only. They must not be used for:
- Call centres, predictive diallers or auto-dialling systems,
- Telemarketing, bulk calling or mass broadcasting,
- Continuous or machine-generated calling,
- Reselling minutes or services to third parties, or
- Any high-volume activity that we consider outside typical use.
6.4 If, in our reasonable opinion, your usage is abusive, excessive or outside normal patterns compared to our customer base, we may:
- Suspend your outbound calling,
- Move you to a different tariff, and/or
- Terminate your Unlimited plan and/or this Agreement.
7. Fraud, misuse & robocalls
7.1 We take fraud and abuse very seriously. You must not use the Service for any illegal, fraudulent or abusive activity, including but not limited to:
- Phishing or scam calls,
- Fraudulent use of payment cards or identities,
- Attempted hacking or unauthorised access to our systems,
- Harassment, threats or unlawful communications.
7.2 Robocalls and automated calling (including SPAM calls, SPIT, auto-diallers and similar systems) are strictly prohibited. Where we detect or reasonably suspect such activity, we may, without prior notice:
- Block specific calls, destinations or traffic types,
- Suspend or restrict your Service, and/or
- Terminate your account and associated numbers.
7.3 If we reasonably suspect fraudulent or seriously abusive use, SecondRing reserves the right, at its sole discretion, to immediately terminate your Service and withdraw any associated numbers, without prior notification. You remain liable for any charges incurred up to the time of termination.
8. Service security
8.1 You are fully responsible for:
- The security of your SecondRing account (usernames, passwords, SIP credentials, etc.),
- The security of your local network, devices and PBX systems, and
- Ensuring only authorised persons access your account.
8.2 We strongly recommend using strong passwords, IP restrictions, firewalls and other security controls. We are not responsible for charges incurred due to compromised credentials or poor security on your systems.
8.3 We may, at our discretion, check or monitor traffic patterns, apply temporary blocks or contact you if we believe your equipment or account is at risk, or our Terms are being breached.
9. Content & acceptable use
9.1 SecondRing does not control or monitor the content of calls, messages or data passing through our network and accepts no responsibility for content, accuracy or legality of communications sent or received via our Services.
9.2 You must not use the Service to:
- Break any applicable law or regulation,
- Harass, threaten, defame or abuse others,
- Misuse emergency services,
- Send SPAM or unlawfully recorded messages.
9.3 We reserve the right to suspend or terminate accounts that, in our opinion, are involved in illegal, abusive or inappropriate use of our Services or are causing network issues.
10. Numbers & numbering rules
10.1 Where we allocate telephone numbers to you, you do not own the number. Number allocation and use may be subject to Ofcom and other regulatory rules.
10.2 You must use numbers in accordance with relevant UK numbering rules and any local regulations. Misuse of numbers may result in suspension or withdrawal of those numbers.
10.3 If you port a number away from SecondRing, your Agreement with SecondRing remains in place for any other Services and fees still due.
11. Service availability & limitation of liability
11.1 We will take reasonable steps to keep our systems up and running; however, we do not guarantee uninterrupted or error-free Service.
11.2 You understand and agree that:
- Outages can occur due to power cuts, broadband failures, maintenance, DDoS attacks or other issues, and
- We may occasionally need to carry out planned or emergency maintenance.
11.3 To the fullest extent permitted by law, SecondRing does not accept liability for any loss, damage or cost arising from:
- Loss of Service, downtime or network issues,
- Loss of profits, business, revenue or data,
- Inability to make or receive calls (including emergency calls), or
- Any indirect or consequential loss.
11.4 If we are found liable to you for any reason, our total liability will be limited to the fees you paid to us in the 30 days immediately before the event giving rise to the claim, unless otherwise required by law.
Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under UK law.
12. Cancellation & termination
12.1 You may cancel your 30-day rolling Service at any time via your online account (or by any method we clearly provide). Your Service will normally continue until the end of the current billing period. Part-month refunds are not given unless required by law.
12.2 We may terminate or suspend your Service immediately if:
- You fail to pay any amounts due,
- We reasonably suspect fraud, abuse or serious breach of these Terms,
- Your usage is excessive or outside acceptable use,
- We are required to do so by law or regulatory authority.
12.3 Upon termination:
- All sums owed up to the date of termination become immediately due, and
- Your access to the Service and any associated numbers may be removed.
13. Changes to these Terms
13.1 We may update these Terms from time to time. Updated Terms will be published on our website and will take effect from the date specified.
13.2 If a change materially reduces your rights in relation to a paid recurring Service, we will give you reasonable notice and the option to cancel before the change takes effect.
14. Governing law & jurisdiction
14.1 These Terms and any dispute arising out of them are governed by the laws of England and Wales.
14.2 The courts of England and Wales will have exclusive jurisdiction over any dispute arising from or relating to this Agreement.
